Deja Videos Terms of Use

Welcome to Deja Videos (hereinafter referred to as "the Product"). This User Agreement (hereinafter referred to as "this Agreement") is entered into by and between you (hereinafter referred to as "User") and Shanghai Eureka AI Intelligent Technology Co., Ltd. (hereinafter referred to as "Eureka AI" or "us"), and applies to all related services of your use of the Product. Before using, please read and agree to all the terms of this Agreement carefully.

Article 1: Account Registration and Management

1. Account Registration: You must provide true, accurate, and complete registration information, including but not limited to mobile phone numbers and verification codes. If the information is false, we have the right to suspend or terminate your service.

2. Account Usage: Your account is for your personal use only and may not be transferred, lent, sold, or shared.

3. Minor Usage: If you are under 18 years old, please read this Agreement under the guidance of a guardian and use this service after obtaining the guardian's consent.

4. Account Security: You must properly keep your account and password, and be responsible for the actions under your account. If you find any abnormal usage, please contact us in time.

5. Account Cancellation: If you need to cancel your account, you can submit an application through the feedback channel or by sending an email to eurekaaitech@gmail.com. After the account is cancelled, your data will be deleted or anonymized in accordance with the law.

Article 2: Service Content

DejaVideos provides the following core services:

1. Character Replacement Feature: Users can upload videos and character reference images, and through the AI technology of this service, replace any character in the video with the character specified by the user, achieving seamless character integration.

2. Video Processing and Generation: This service supports a variety of video processing functions, including but not limited to video optimization, editing, and style reshaping, to help users achieve creative expression.

3. User Custom Uploads: You can upload videos, images, audio, and other content according to your needs, and process them individually through platform tools.

4. Project Management and Storage: This service provides project management functions for users, supporting the management of uploaded content and generated video files.

If this service is updated or additional functions are added, we will inform you through platform announcements, notifications, and other means.

Article 3: Users' Rights and Obligations

1. Service Usage Rights: You have the right to use the services provided by DejaVideos in accordance with the terms of this Agreement, including but not limited to character replacement and video generation functions.

2. Content Compliance: You must not upload, generate, or disseminate the following content:

Information that opposes the basic principles of the constitution, endangers national security, or incites crime;
Information that infringes on the intellectual property rights, privacy rights, and other legitimate rights and interests of others;
Information containing illegal content such as pornography, violence, terrorism, and fraud.

3. Reasonable Use:

You must not maliciously register, crack services, interfere with platform operations, or engage in unfair competitive acts through this service;
You must not use technical means to bypass, modify, or destroy the security measures of the platform;
You must not engage in data scraping, reverse engineering, decompilation, or other such acts.

4. User Content Compliance: You guarantee that the content you upload has legal rights and does not infringe on the legitimate rights and interests of third parties. If disputes arise, you shall bear all responsibilities and compensate us for any losses caused, including reasonable legal fees.

5. Violation Handling: If you violate the terms of this Agreement, we have the right to take measures such as warnings, restrictions on use, suspension of services, deletion of content, account bans, and reserve the right to pursue legal responsibilities.

Article 4: Our Rights and Obligations

1. Service Maintenance: We will continue to provide safe, stable, and reliable services to ensure normal use by users, and promptly fix technical faults and optimize user experience.

2. Violation Handling: If we find that you have violated this Agreement or relevant laws and regulations, we have the right to immediately take the following measures:

Warning notices, requiring you to correct violations in a timely manner;
Restricting or suspending some functional services;
Deleting violations;
Banning accounts and terminating services.

3. Data Protection: We will strictly comply with the "DejaVideos Privacy Policy," legally protect your personal information and privacy security, and will not disclose your information unless authorized by you or otherwise stipulated by laws and regulations.

4. Information Management: We have the right to review the content you upload and handle illegal and illegal content in accordance with laws, regulations, industry standards, and the requirements of this Agreement.

5. Service Adjustment: We have the right to adjust, upgrade, suspend, or terminate the content of services based on technological development, market demand, and laws and regulations, and notify users through announcements or other reasonable means.

Article 5: Intellectual Property Rights

1. Platform Rights: All content in the DejaVideos platform and services, including but not limited to software, code, interface design, text, images, audio, video, charts, trademarks, LOGOs, data, and other related content (hereinafter referred to as "Platform Content"), its copyright, trademark rights, patent rights, trade secrets, and other intellectual property rights belong to Eureka AI or relevant rights holders and are protected by law.

2. Usage Restrictions:

Without our or the relevant rights holders' written permission, you must not copy, modify, disseminate, rent, sell, reverse engineer, decompile, or create derivative works based on Platform Content in any form;
You must not delete, modify, or hide any copyright notices, trademark logos, or other rights notices related to Platform Content;
You must not use the content provided by this service (including generated content) for commercial purposes or other unauthorized uses.

3. User Content:

The copyright of the content you upload, publish, or generate (hereinafter referred to as "User Content") belongs to you or the original rights holder;
You agree to grant us and our affiliated companies a non-exclusive, worldwide, free license to use User Content for the purpose of providing and improving services, including but not limited to storage, processing, display, dissemination, copying, modification, and technical optimization;
You ensure that User Content does not infringe on the intellectual property rights, privacy rights, or other legitimate rights and interests of third parties, and if disputes arise, you must bear all legal responsibilities.

4. Rights Protection: If you believe that the content of this platform or this service infringes on your legitimate rights and interests, you can submit a rights notice through the user feedback channel or by sending an email to eurekaaitech@gmail.com. We will handle it according to the law.

Article 6: Disclaimer

1. Service as is: The service is provided as is with the existing technical conditions, and we do not guarantee the continuity, accuracy, and flawlessness of the service.

2. Third-party content: If you use third-party plugins or links, please discern for yourself, and we are not responsible for the authenticity and security of third-party content.

3. Usage risk: We are not responsible for service interruptions or data loss caused by force majeure, network failures, or other reasons.

Article 8: Feedback

2. We will take your feedback very seriously and handle and reply to your request within 15 working days.

Article 9: Agreement Modification

We have the right to modify this Agreement according to business needs. The modified Agreement will be published on the DejaVideos platform. If you disagree with the modified content, you have the right to stop using this service. Continued use is deemed as your agreement to the revised Agreement.

Article 10: Law and Jurisdiction

This Agreement is governed by the laws of the People's Republic of China. Disputes arising from this Agreement should be submitted to the People's Court located in the location of Eureka AI for resolution.
